Warranty that specifically excludes consequential and incidental
damages and there are limitations in the duration of implied warranty. The =
home
and it’s components pass all town & state building codes. Any cha=
nge
in the codes after installation of a product will not be the responsibility=
of
the builder.

Closing: Each new homeowner will have a detailed walkthrough pr=
ior
to closing. A “punchlist” of open items if any will be made at =
that
time. Homeowners may elect to have a home inspection at their cost before
closing. Please read each section carefully. Cosmetic defects have very specific time limitations.
Terms of Coverage: The terms of the vario=
us
coverage of this Limited Warranty begin on the date on which this property =
is
deeded the BUYER or on the date on which the BUYER first occupies the dwell=
ing,
whichever occurs first. That =
date
is referred to in this document as the “date of possession”.
Basement or Crawl: For a period of one year after the=
date
of possession, the foundation shall remain structurally sound and the basem=
ent
area shall remain free of water caused by seepage occurring during periods =
of
normal high ground water table or caused by springs.
Excluded from coverage: A wet basement resulting from any
unusual rains greater than 2” within a 24 hour period, tornado,
hurricane, or general flood. Wetness or dampness in the basement area cause=
d by
pipe condensation or any other humidity-related cause.
If there is a water problem within the warranty period. SELLER shall have the option of installing a pit with a sump pump.
Concrete Foundation & Floor: <= /b>For a period of 1 year after the date of possession, the foundation shall remain structurally sound. All concre= te in your home has been installed in accordance with the rec= ommendations of an engineer. It is not possible to prevent cracking. Cracks which admit water will be sealed by the builder.
Excluded from coverage: Cracks in concrete wa= lls or slab floors due to drying, curing, expansion or contracting which do not otherwise affect the structural integrity of the dwelling. Cosmetic covering solutions will be the responsibility of the homeowner.
Frame Structure: For the period of one year after t=
he
date of possession, the structural frame members of the dwelling will be fr=
ee
of substantial defects in material or workmanship.
Excluded from coverage: Expansion, contraction, shrinkag=
e or checking of frame lumber not aff=
ecting
the structural integrity of the dwelling from defects which are the result =
of
characteristics common to the materials used, such as but not limited to
warping and deflection of wood.
Roof: For a period of one year after the=
date
of possession, the roof will be free of leaks caused by defects in material=
s or
workmanship.
Excluded from coverage: Leaks in the roof or attic area
resulting from rain blowing in through vents or caused by ice buildup or
backup. Gutters & downspouts must be kept clear by the homeowner.
Heating System: For a period of one year after the=
date
of possession, the heating system will be free of substantial defects in
materials and workmanship.
Excluded from coverage: The heating of garages, attics,
basement’s not finished by builder prior to transfer of title, storage
areas and/or crawl spaces.
Plumbing System: For the period of one year after t=
he
date of possession, the plumbing system will be free of substantial defects=
in
materials or workmanship.
Excluded from coverage: Freezeups resulting from the
BUYER’S use of a wood and/or coal stove automatic setback thermostats=
or
any other reason; condensation due to humidity. Any sinks, faucets or fixtures sup=
plied
by BUYER shall not be covered.
Electrical Wiring System: For the period of one year after d=
ate of
possession, the electric wiring system will be free of substantial defects =
in
materials and workmanship.
Excluded from coverage: Electric switches, receptacles,, a=
nd
circuit breakers will be covered for a period of 30 days after the d=
ate
of possession only. Any fixtu=
res or
appliances supplied by BUYER shall not be covered.
Other: For a period of 30 days aft=
er the
date of possession, the following items will be covered:

caused by customer. Defects must be identified in advance before closing. Manufacturer’s Warranties: The SELLER hereby passes through a=
nd
assigns directly to the BUYER any and all manufacturers’ warranties on
all appliances and equipment supplied by the SELLER in the dwelling. The following is a partial list of=
examples
of such equipment and appliances; v Refr=
igerator,
microwave oven, kitchen range, dishwasher, garbage disposal, heating furnac=
e or
boiler, windows, Foundation waterproofing, (all only where applicable to and
included in the sale of the particular dwelling). After the builder warranty period, customers will be giv=
en a
list of vendors to contact directly on issues. As part of the pass through of these or any other
manufacturers’ warranties on equipment or appliances included in the
purchase of the dwelling the BUYER is hereby informed that such warranties =
may
include a specific procedure which must be followed to make that warranty
effective. The procedure may
require notification or registration by the BUYER to the manufacturer immed=
iately
upon occupancy of the dwelling. The BUYER’s failure to register or ma=
il
such a warranty card according to any manufacturer’s requirement shall

responsibility for any of the following items, each of which is specificall=
y excluded
from this Limited Warranty: =
1.&n=
bsp;
Defects in appliances or equipment covered by
manufacturer’s warranties; as these have been assigned directly to the
BUYER, each manufacturer’s warranty claim procedure must be followed
where a defect appears in any of those items. =
2.&n=
bsp;
Damage due to ordinary wear and tear; abusive use=
or
misuse by the BUYER or member of the BUYER’s household, workmen emplo=
yed
by the BUYER, guests of the BUYER, or person or persons unknown; or by lack=
of
proper maintenance of the swelling or its component parts of systems. =

Defects in items installed or work performed by t=
he
BUYER or anyone other than the SELLER or at the SELLER’s specific
direction; defects in items supplies by the BUYER; defects in items install=
ed
at the BUYER’s request which are nonstandard items. =

Damage to plumbing drains or clogging thereof
resulting in the backup of wastewater caused by the disposal into said drai=
ns
of any household object. =
5.&n=
bsp;
Defects the result of characteristics common to
materials used, such as, but not limited to warping, checking, shrinkage or
deflection of wood; cracks due to drying, curing, expansion or contraction =
of
concrete, plaster, brick or masonry; drying, shrinking and cracking of caul=
king
and weather-stripping; mildewing, fading or discoloration of exterior stain;
fading, shipping or peeling of any painted surface. =

Damage, loss or injury due to natural causes, the
elements or any other Act of God. =
7.&n=
bsp;
Consequential or incidental damages. Municipal Water Service Warranty: The SELLER will not be liable for =
any
service difficulties that may arise beyond the date of possession with a
municipal water service serving the dwelling. The Service connection between the=
curbs
stops and the water main is the responsibility or the municipality, as is t=
he
water pressure and quality of water. Implied Warranties: All implied warranties including, =
but
not limited to warranties of merchantability, fitness for a particular purp=
ose,
and habitability, with respect to the property hereunder, are limited to the
warranty periods as set forth above. No Other Warranties: This Limited Warranty is the only
expressed warranty we give. T=
his
Limited Warranty gives the BUYER specific legal rights and the BUYER may al=
so
have other legal rights, which vary from state to state. Claim procedure: If a defect should appear which you
think is covered by this Limited Warranty, you must notify the SELLER promp=
tly
in writing at the address appearing at the end of this document. Describe the defect briefly and te=
ll us
when you will be home so we can schedule service calls appropriately. If delay will cause additional dam=
age
(e.g. if a pipe burst) telephone us. Only emergency
reports will be taken by phone; in the event of such emergency reports, we =
will
notify the appropriate tradesman/sub-contractor that an emergency condition
exists which should be responded as soon as possible. Repairs: Upon receipt of the BUYER’s
written report of a defect, if the defective items are covered by this Limi=
ted
Warranty, the SELLER will repair or replace the item at no charge to the BU=
YER
within 30 days (longer if weather conditions, labor problems or materials
shortages cause delays). The =
work
will be done by the SELLER or subcontractors chosen by the SELLER. The choice between repair or repla=
cement
is ours, which much be reasonable and made in good faith. In respect to emergency repairs pl=
ease
see the provision in the previous paragraph. Waiv=
er: In the event that Buyer is in defa=
ult
under any Agreement with Seller, including but not limited to, the failure =
to
release funds for work completed pursuant to any escrow agreement and or
agreement to perform services post-closing, which Buyers default continues =
for
ten (10) business days after written notice, the Sellers performance hereun=
der
shall be excused without further notice. Severability: In the event that any of the provi=
sions
of this Limited Warranty shall be held to be invalid, the remainder of the
